1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Auto Market Explorer platform (the “Service”), operated by AKP Ventures Ltd, a company registered in England and Wales under company number 15968817 (referred to herein as “we”, “us”, or “the Company”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of the Terms, you must not access or use the Service.

2. Service Description

Auto Market Explorer is a vehicle monitoring platform that scans approved-used car programmes operated by UK manufacturers. The Service provides inventory browsing, price analysis, and alert notifications when vehicles matching user-defined criteria are detected.

The Service does not sell vehicles. All vehicle listings are sourced from manufacturer-operated approved-used programmes. We act solely as an information aggregator and alert service. Any purchase decisions and transactions are between you and the relevant manufacturer or dealer.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account Registration

To access the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately at [email protected] if you become aware of any unauthorised use of your account.

5. Subscription and Payment

The Service offers a free tier and two paid plans:

• Free (£0/month) — browse inventory and filters only. No alerts, no fair price estimates.
• Basic (£1.99/month) — up to 5 alerts, email notifications, fair price estimates.
• Pro (£9.99/month) — unlimited alerts, email and SMS notifications, fair price estimates.

Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the renewal date. All fees are stated inclusive of applicable taxes unless otherwise specified. We reserve the right to modify subscription fees upon reasonable notice.

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to the Service until that date.

Refunds are provided in accordance with applicable consumer protection legislation, including the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, where applicable.

7. Accuracy of Information

Vehicle information displayed through the Service is sourced from third-party manufacturer programmes. We make reasonable efforts to ensure accuracy but cannot guarantee that all information (including prices, specifications, availability, and images) is complete, current, or error-free.

You should verify all vehicle details directly with the relevant manufacturer or dealer before making any purchase decision.

8. SMS Notifications

Pro plan subscribers may opt in to receive SMS notifications. By providing your mobile phone number and enabling SMS alerts, you consent to receiving automated text messages from us regarding your alert matches.

SMS messages are subject to daily (10 per day) and monthly (30 per month) caps. Standard message rates from your mobile carrier may apply. You may disable SMS notifications at any time through your account settings.

9. Intellectual Property

All intellectual property rights in the Service, including but not limited to software, design, text, graphics, logos, and trademarks, are owned by or licensed to AKP Ventures Ltd. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the Service or any systems connected to it.
• Use automated means (including bots, scrapers, or crawlers) to access the Service or extract data without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Share, redistribute, or resell access to the Service or any data obtained through it.

11. Limitation of Liability

To the maximum extent permitted by applicable law, AKP Ventures Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

Our total aggregate liability shall not exceed the total fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by English law.

12. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that vehicle data will be accurate or complete.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
